Terms of Service

By accessing or using Elvie ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, do not use the Service. These Terms constitute a binding agreement between you and Luke Bedikian, operating as Elvie Trading Systems (DBA Elvie), a sole proprietorship based in California.

Elvie is an automated signal execution software tool designed for use with TradingView-compatible platforms and supported prop firms. The Service is not financial advice, investment advice, a managed trading service, or a commodity trading advisory service. Elvie does not manage your money, hold your funds, or make discretionary trading decisions on your behalf. You, the user, retain full responsibility for all trading activity conducted through or in connection with the Service. All trades occur under your own brokerage or prop firm account and at your sole discretion and risk.

Luke Bedikian and Elvie are not registered as an investment advisor, broker-dealer, commodity trading advisor (CTA), commodity pool operator (CPO), or in any advisory capacity with the SEC, CFTC, NFA, FINRA, or any other regulatory body. Nothing on this site or within the Service constitutes a recommendation to buy or sell any security, futures contract, or other financial instrument. You should consult a licensed financial professional before making any trading decisions.

Past performance is not indicative of future results. All performance data, statistics, equity curves, win rates, profit factors, and P&L figures displayed on this site or within the Service are for informational purposes only and do not constitute a guarantee or promise of future returns. Hypothetical or simulated performance results have inherent limitations and do not represent actual trading results. Forward-tested results reflect live market conditions during a specific time period and may not be reproducible. Actual results will vary materially based on market conditions, account size, prop firm rules, slippage, platform outages, and other factors outside Elvie's control. Algorithmic strategies may behave unexpectedly during abnormal market conditions, black swan events, flash crashes, or periods of extreme volatility. Trading futures involves significant risk of loss and is not suitable for all investors. You may lose all capital in your trading account.

Elvie is designed to operate within common prop firm parameters but makes no guarantee of compliance with any specific firm's current rules. Prop firm rules, drawdown limits, and platform APIs are subject to change without notice. You acknowledge that: Elvie is not affiliated with, endorsed by, or partnered with Topstep, Lucid, or any other prop firm or trading platform, except where explicitly disclosed. Elvie may earn referral compensation from TradingView and TradersPost through affiliate links, which will be clearly disclosed at the point of use. Elvie is not responsible for account violations, funded account terminations, evaluation failures, or any loss of prop firm capital arising from use of the Service. Platform outages, API errors, connectivity issues, or execution delays may affect performance and are outside Elvie's control. Rule changes by prop firms may render the Service temporarily or permanently incompatible without notice.

Access to Elvie is provided on a monthly subscription basis. By subscribing, you authorize recurring charges to your payment method on file through our payment processor, Stripe. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. All fees are non-refundable. Due to the digital nature of the Service and immediate access upon purchase, no refunds will be issued after payment is processed, including for partial months. Elvie reserves the right to modify pricing with 30 days' notice to active subscribers. Founder tier pricing is honored for the billing cycle in effect at time of purchase and is not guaranteed beyond that period. Elvie reserves the right to terminate your subscription for any violation of these Terms without refund.

To the maximum extent permitted by applicable California law, Luke Bedikian and Elvie shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service, including but not limited to: • Trading losses or loss of funded account capital • Loss of profits, revenue, or business opportunity • Account termination by a prop firm or broker • Missed trades, delayed execution, or platform errors • Losses arising from abnormal market conditions or algorithmic behavior • Force majeure events including exchange outages, broker failures, or acts of God In no event shall Elvie's total aggregate liability exceed the total subscription fees paid by you in the three (3) months immediately preceding the claim.

You agree to indemnify, defend, and hold harmless Luke Bedikian and Elvie from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your trading activity.

Users may not copy, share, resell, sublicense, distribute, reverse engineer, decompile, disassemble, or otherwise attempt to derive the proprietary logic, strategies, indicators, filters, software, code, configurations, or intellectual property underlying the Service. Each subscription is licensed for individual use only on trading accounts personally owned or controlled by the subscriber. Sharing account access, credentials, alerts, setup materials, documentation, proprietary information, or any portion of the Service with another person is strictly prohibited. Users may not use the Service, Discord community, support channels, member directory, or related resources to: • Develop, reproduce, market, promote, or support a competing product or service. • Collect information for the purpose of recreating or reverse engineering the Service. • Recruit, solicit, contact, or redirect members to another community, product, service, or business. • Request or share proprietary strategy information, including indicators, filters, entries, exits, risk settings, alert configurations, or trading logic. • Circumvent access controls, subscription restrictions, or security measures. Any suspected or confirmed violation may result in immediate suspension or termination of access to the Service and community without refund. Elvie Trading Systems reserves the right to investigate conduct that it reasonably believes may threaten its intellectual property, business, users, or community.

Access to the Elvie Discord community and related support channels is a privilege included with an active subscription. Members may not solicit users, promote competing products or communities, distribute unauthorized links, collect proprietary information, harass other members, disrupt community operations, or engage in conduct that conflicts with the purpose of the community. Elvie Trading Systems reserves the right, in its sole reasonable discretion, to restrict, suspend, or permanently remove any member whose conduct is considered harmful to the Service, its intellectual property, its users, or the community. Removal from the Discord community or termination for a violation of these terms does not create an entitlement to a refund.

Any dispute arising out of or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in California under the rules of the American Arbitration Association. Class action lawsuits and class-wide arbitration are expressly waived.

Elvie reserves the right to modify, suspend, or discontinue the Service at any time with reasonable notice. These Terms may be updated at any time — continued use of the Service after changes constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of California. Any disputes not resolved through arbitration shall be brought in the state or federal courts located in California.
